1) APPLICATION OF THE T&Cs

These general conditions of sale (GTC) govern the contractual relationship (sales of products or services) of the seller (a cat in my boot) with the customer of the site.
The Customer must read the T&Cs prior to any order (the "Order"), the T&Cs being available on the Site.
Any placing of an order is valid for full acceptance of these conditions. They will prevail over all other conditions appearing in any other document, except prior, express and written derogation from the seller. They can be modified at any time by the seller without notice. The applicable conditions will be those in force on the site at the time of validation of the order.

2) INFORMATION ON THE SITE AND ACCESSIBILITY OF THE SITE

www.unchatdansmabotte.com is an e-commerce site owned and operated by un chat dans ma botte.
The Site is accessible to all users of the Internet network in principle 24 hours a day, 7 days a week, interruptions due to the need for maintenance and/or security or cases of force majeure may be decided by Un chat dans ma botte. Un chat dans ma botte cannot be held responsible for any damage, whatever its nature, resulting from the unavailability of the Site.

3) REGISTRATION ON THE SITE

To be able to place an Order, the Customer must first register on the Site by creating an account containing the Customer's information (the "Account").
The Customer's registration on the Site is validated by Un chat dans ma botte after verification of the standard form completed by the Customer. The Customer receives a registration confirmation email.

When creating his Account, the Customer must ensure the accuracy and completeness of the data he provides. The Customer is required to always update his personal information. In the event of an error in the wording of the recipient's contact details, Un chat dans ma botte cannot be held responsible for the impossibility of delivering the Products.

By registering on the Site, the Customer declares and guarantees to Un chat dans ma botte that he is of legal age and has the legal capacity to contract.

A cat in my boot may delete the Customer's Account at any time, for any reason, in its sole discretion.

4) PRODUCTS
The Products offered for sale are those described on the Site on the day the Customer consults the Site, within the limits of available stocks. These indications are updated automatically in real time. However, an error in the update, whatever its origin, does not engage the responsibility of Un chat dans ma botte. As such, Un chat dans ma botte cannot be held responsible for the cancellation of an Order for a Product due to the depletion of stocks.

Un chat dans ma botte takes the greatest care in the presentation and description of its products to best satisfy the Customer's information. It is nevertheless possible that errors may appear on the Site, which the Customer acknowledges and accepts.

Un chat dans ma botte does not guarantee the accuracy or security of information transmitted or obtained through the Site.

5) ORDERS
Taking an Order on the Site is subject to compliance with the procedure set up by the publisher CMS Shopify and cat in my boot on the Site comprising successive stages leading to the validation of the Order.

The Customer can select as many Products as he wishes which will be added to the basket (the "Basket"). The Basket summarizes the Products chosen by the Customer as well as the prices and costs relating thereto. The Customer may freely modify the Basket before validating his Order. The validation of the Order constitutes confirmation of the acceptance by the Customer of the GCS, the Products purchased, their price as well as the associated costs.

A confirmation email summarizing the Order (Product(s), price, availability of the Product(s), quantity, etc.) will be sent to the Customer by Un chat dans ma botte via Shopify. To this end, the Customer formally accepts the use of e-mail for confirmation by Un chat dans ma botte via Shopify of the content of his Order.

6) REFUSAL TO PROCESS AN ORDER
Un chat dans ma botte reserves the right to withdraw any Product displayed on the Site at any time and to replace or modify any content or information appearing on the latter. Despite Un chat dans ma botte's best efforts to meet the expectations of its customers, the latter may refuse to process an Order after having sent the Customer the confirmation email summarizing the Order.

Un chat dans ma botte cannot be held liable to the Customer or a third party for the harmful consequences of the withdrawal of a Product from the Site, or the replacement or modification of any content or information appearing on this Site, or even the refusal to process an Order after sending the confirmation email summarizing the Order.

Un chat dans ma botte also reserves the right to refuse or cancel an Order from a customer with whom it has a dispute over the payment of a previous order.

7) PRICE AND PAYMENT

PRICE
Prices are expressed in Euros including VAT, excluding shipping costs.
VAT is not applicable, article 293B of the general tax code.

un chat dans ma botte reserves the right to modify its prices at any time, but the Products will be invoiced on the basis of the prices in force at the time of registration and payment of the Order, subject to availability.

PAYMENT
The products ordered as well as the shipping costs are payable when ordering, in euros or in the currency of the destination country. The buyer may, at his option, use electronic payment by secure credit card via the payment provider Stripe on the Site, or PAYPAL.
The Products are payable in cash when the actual Order is placed.

8) DELIVERY

The processing of the order will take place between 2 and 10 working days for France, and 6/14 working days for the rest of Europe (including the time for making the engravings) (depending on the formula chosen and the country of destination) after collection of the full price, including shipping costs.
It is only made after confirmation of payment by the seller's bank.
The parcels are sent by the postal services.
Upon receipt, the buyer is required to check its conformity and condition.

Un chat dans ma botte can not be held responsible for any delays or losses of postal services.

FOR FRANCE
Parcels are sent by Letter followed, Colissimo or Chronopost
(delays 2 to 10 working days on average depending on the product - Delays can be 10 days for certain products, such as for hand-engraved objects. Manufacturing time included.)
In the event of a busy period, an additional period of 3/5 days may be necessary. This time will be specified on the site on the home page in the paragraph: "delivery times" when a cat in my boot can estimate it.

In the event of absence during delivery, a delivery notice will be left in the mailbox in order to be able to collect the package at the nearest post office (within 15 days)

The prices vary according to the weight of the parcels.

9) RETURN CONDITIONS

You have the right to change your mind, and also of course to be reimbursed for a defective product according to the conditions below:

A) RIGHT OF WITHDRAWAL
You have changed your mind and the product (in good condition) does not suit you?

Under the law of January 3, 2008, the online buyer has a period of 14 clear days, from the date of delivery, to return, at his expense, the products that do not suit him.
Special conditions apply to personalized engraved objects: see "personalized articles" below.

All returns must be notified in advance by email to hello@unchatdansmabotte.com. The product must be returned, in good condition, by letter followed or by registered colissimo (depending on the delivery option of the product) to the address which will be indicated by return mail.

Only products returned as a whole, in perfect condition for resale, will be taken back.
Any product showing signs of wear or which has been damaged will not be refunded or exchanged.

The customer will have the choice to request either the refund of the sums paid, or the exchange of the product. In the case of an exchange, the re-shipment will be at the customer's expense. In the case of a refund, it will be made within 15 days.

Personalized items: Given the unique and personalized nature of the personalized/engraved item, it cannot be returned or exchanged in accordance with article L121-21-8 of the Consumer Code:
“The right of withdrawal cannot be exercised, for contracts: (…) 3° For the supply of goods made to the specifications of the consumer or clearly personalized …”.
It follows that you have no right to invoke any right of withdrawal. Also, we recommend that you devote the necessary time and attention to the creation of your article.

B) CLAIM in the event of a manufacturing defect or other problem related to the quality of the product

The product is defective, arrived in poor condition? Send us a photo at hello@unchatdansmabotte.com. In this case, we will reimburse the cost of returning the goods if necessary.

The customer is required to check the condition of the products upon receipt. The customer has a period of 3 days from the delivery of the product to make any complaints to the seller. He can do this by email to Hello@unchatdansmabotte.com, by sending us a photo of the damaged product.

Any complaint not made in the rules defined above, and within the time limits, cannot be taken into account and will release the seller from any liability vis-à-vis the customer.

This right also applies to sale, second-hand or destocking products.

In the event of a manufacturing defect or other problem related to the quality of the product, Un chat dans ma botte will have to reimburse the product as well as the costs of normal delivery, within 14 days of receipt.

If the customer prefers, the defective product will be replaced, after receipt by a cat in my boot of the defective product. The return postage will be borne by a cat in my boot.

10. COOKIES

In order to improve the Site, Un chat dans ma botte uses audience measurement cookies, such as the number of page views, the number of visits, the activity of visitors to the site, and their frequency of return thanks to Shopify and Google Analytics statistics services.
